Limitation of Liability

To the fullest extent permitted by law, our total cumulative liability to you for any claims arising out of or relating to these Terms or the use of the Services shall not exceed the amount actually paid by you to Narrowpath for the specific Service in question in the twelve (12) months immediately preceding the event giving rise to the claim. If you have not paid any amount to us (for example, if you use free features of the website), our liability will be zero to the extent allowed by law.
Exceptions: Nothing in these Terms limits or excludes our liability for gross negligence, willful misconduct, fraud, or any other liability that cannot be limited or excluded under applicable law (such as death or personal injury caused by our negligence). Additionally, the limitations above are subject to any consumer rights under law; if you are using the Services as a consumer, you may have certain remedies available under local law that are not waived by these Terms. In any case, you agree that our liability will be limited to the greatest extent permitted by law.
Indemnification

The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply to these Terms.
Jurisdiction: You and Narrowpath agree that all legal actions or proceedings arising out of or relating to these Terms or the Services shall be brought exclusively in the competent courts of Madrid, Spain, unless another jurisdiction is mandatorily required by applicable law (for example, certain consumer protection laws might allow consumers to bring claims in the courts of their country of residence). By agreeing to these Terms, you consent to the personal jurisdiction of these courts and waive any objections (such as objections based on inconvenience) to the exercise of jurisdiction by those courts.
Injunctive Relief: Notwithstanding the above, you acknowledge that unauthorized use of our Services or infringement of our intellectual property may cause irreparable harm to Narrowpath for which monetary damages would be insufficient. In such cases, we may seek injunctive or equitable relief in any court of competent jurisdiction to stop or prevent such unauthorized use or infringement, in addition to any other remedies available at law.
